Service of Process
Frequently Asked Questions
What is a Service of Process?
Formally notifying the defendant that a suit has been filed against the defendant, made by certified mail, or by personal service, or by substituted service.
What are the Colorado rules for Service of Process? A list of the Colorado rules of civil procedure can found here.
Why do I need a Process Server?
Official service of a summons and a copy of your complaint or petition is necessary to start a legal action by giving the other side formal notice there is a lawsuit filed against them. Otherwise, your case cannot proceed through the court system. After serving the other parties in your civil case, the process server files a return of service with the Court so that the judge will know this has been done according to the law. You cannot serve the other side yourself.
What if I still have questions after reading these instructions?
We do not work for the court and we are not lawyers; please contact a lawyer for any legal advice. If you do not have a lawyer and seek legal advice, please contact Colorado Statewide Directory of Local Pro Bono Programs.
